ForensiMark Terms of Service

These terms describe the current ForensiMark service, merchant responsibilities, Shopify billing model, technical limitations, and mandatory human-review boundaries.

Service and operator

ForensiMark is a product of Taqwa Vows LLC and is provided as a Shopify application. It offers image and video protection tooling, traceable media delivery, watermark recovery, public-web discovery, brand and impersonation review signals, evidence records, alerts, analytics, ownership evidence certificates, merchant support, billing, and DMCA draft workflows.

Merchant authority and account access

The person installing or using ForensiMark must be authorized to act for the Shopify store. Merchant administration is accessed through Shopify authentication. The merchant is responsible for controlling staff access to Shopify Admin and for the accuracy of information entered into ForensiMark.

Permitted use and merchant responsibilities

Authorized content only

Merchants must protect, search, report, or submit claims only for content and brands they own or are authorized to manage.

Lawful review

Merchants must review evidence, ownership details, target URLs, good-faith statements, and applicable law before sending any legal notice or relying on a technical report.

No abusive automation

The service must not be used for harassment, false claims, unauthorized surveillance, unlawful collection, platform abuse, or attempts to bypass rate limits, authentication, billing, or technical safeguards.

Configuration and review

Merchants are responsible for choosing suitable settings, reviewing alerts and Potential Matches, maintaining accurate contact details, and testing protection behavior on their storefront.

Detection, AI, and evidence limits

Public-web search and comparison results are technical review signals. Depending on deterministic evidence and classification, the interface can use wording such as Potential Match or Suspected Infringement. These labels do not by themselves prove infringement, counterfeiting, authorization status, ownership, or damages.

AI and multimodal analysis remain assistive. Merchant review is mandatory. A zero-result search does not prove that no unauthorized use exists, and a positive result can still be a false or authorized match.

DMCA and legal workflow

ForensiMark creates reviewable drafts from merchant-supplied information and technical evidence. Drafts and legal evidence reports are not legal advice. Merchant confirmation, ownership review, electronic signature, and good-faith statements remain the merchant's responsibility before any submitted status.

Global and shop-level kill switches, idempotency controls, and audit records are safety mechanisms; they do not transfer legal responsibility from the merchant.

Certificates and reports

An ownership evidence certificate records merchant-supplied identity and ForensiMark technical protection data at a stated time. It is not a government copyright registration, a legal determination of ownership, or proof of authorship by itself. Other reports are likewise technical records prepared for merchant review.

Protection limitations

No browser technology can completely prevent screenshots, cameras, copying, cropping, recompression, screen recording, developer-tool access, or deliberate removal attempts. Visible and invisible watermark recovery depends on the source, transformation, quality, and attack method.

Screenshot-related browser shortcuts are recorded only as possible capture signals and cannot prove that a screenshot occurred.

Plans, trials, billing, and cancellation

Plan features, prices, included usage, trial days, fair-use thresholds, and any usage-based charges are displayed inside the application and the Shopify approval flow. Paid subscriptions require merchant approval through Shopify Billing. The current paid-plan configuration uses 30-day recurring subscriptions and can include a 14-day trial.

A plan change can require approval of a replacement Shopify subscription. Usage-based charges, where enabled, are created through Shopify with idempotency controls and a displayed capped amount.

Uninstalling the application causes Shopify to cancel the app subscription. ForensiMark does not publish a separate money-back or refund guarantee in these terms. Credits, billing adjustments, and non-waivable consumer rights remain subject to Shopify's billing mechanisms and applicable law.

Availability, changes, and support

The service depends on secure hosting, TLS, secrets, private storage, background jobs, third-party APIs, Shopify availability, billing configuration, and operational maintenance. Features can be limited, paused, or unavailable because of plan limits, provider failures, safety switches, maintenance, or technical incidents.

No 24/7 support promise, fixed response-time SLA, zero-breach guarantee, or uninterrupted-availability guarantee is made in these terms. Installed merchants can create authenticated support tickets inside the application.

Suspension, uninstall, and data

Access can be limited when required to protect the service, enforce plan limits, stop unsafe legal automation, investigate abuse, or comply with platform obligations. Merchants can delete ForensiMark data or uninstall from the authenticated Privacy & Data controls.

Data handling after deletion or uninstall follows the published Privacy Policy and the implemented Shopify privacy-webhook workflows.
